Louisville jury punishes company with $7.25 million verdict for selling Meade County girl defective ear implants that shocked her.

LOUISVILLE, Kentucky -- An electrical short caused an 8-year-old girl to be thrown to the ground, vomiting and convulsing. The shocks happened two more times until the device was disconnected. Born Deaf, Breanna Sadler of Vine Grove, Ky., had a cochlear ear device implanted in her head in 2006, when she was 4 years old. Four years later, an electrical short from the device shocked her so violently that she was thrown to the ground, vomiting and convulsing.

After she was shocked two more times, the device had to be removed from her skull and replaced with a competitor’s model in an open-head surgery that took more than seven hours.

Breanna’s parents sued the manufacturer, Advance Bionics of Valencia, Calif., accusing the company of continuing to sell the device after executives knew it was leaking and defective. On Tuesday a U.S. District Court jury in Louisville agreed, awarding Breanna, now 11, and her parents $7.25 million in damages.

In the first of about 40 lawsuits filed nationally to go to trial, the jury said the company should pay $6.25 million in punitive damages alone for recklessly disregarding patient safety.

The Sadlers’ lawyers presented evidence that Advance Bionics executives delayed disclosing the defect so they could sell more devices and get more money when the company was sold. They “chose to ignore risks and focus on profits,” the attorneys said in a brief.

About 4,000 of the devices have been implanted worldwide, and about 1,000 have failed, according to lead plaintiff’s counsel Tim Edwards, who estimated that dozens of patients in the Louisville area are “walking around with the devices in their head that have failed or will fail.”... Deaf Woman Viciously Attacked By Pit Bull

Deaf Kentuckian woman mauled by pit bull dog.

LOUISVILLE, Kentucky -- A 59-year old Deaf woman who lives in an assisted adult care home because of her special needs is in the hospital after being mauled by a pit bull. She couldn't hear the dog coming or even form the words to say help.

Tony Simpson, who witnessed the attack, tells WDRB News, "I've never never seen nothing like that."

The two-year-old pit bull named Rambo sits quarantined in a steel cage at the Breckinridge County Animal Shelter.

Stacey Lucas and her fiance Tony Simpson say the last time they saw the dog in Cloverport, it was trying to tear Shirley Sturgeon apart.

Simpson says, "The dog was literally just eating the woman. He was not just biting her. He was tearing her meat off and swallowing it."

Shirley Sturgeon lives at Breckinridge Manor. She is deaf and was walking down a road Saturday on the way to a friend's house. It was just about a block from her home that Rambo attacked as she walked up the road... Read The Full Story.

NAD Voting System Rigged?

The Election Committee of the National Association of the Deaf voting system fraudulent.

How does the voting system works during selection of National Association of the Deaf Officers. Questions about how the delegates are supposed to do at NAD Conference. Numerous of Deafies heard about the voting had been rigged. This controversy began with the misinterpretation of the results of a voting system.

The Deaf Community keeps hearing different stories such as favoritism and fixture but a certain if they all are true, however, one source said the voting system can be cheated when the ballots are counted to choose by the NAD staff. It is damaged now and it is disgusted for the Deaf Community and will fight it in next election of 2014. The thing is it's the special interest groups such as Z|CSDVRS keep NAD positions in their hands for a number of years. Way too long. They should allow others to run NAD for a change. People's rationale about being a delegate but sit is according to the NAD bylaws that change comes through the State Associations.

Terms of "Status Quo" and "Patronizing Deaf Community." What Ridor said just now is exactly the same thing a State Association of the Deaf is doing to the State Deaf Community. It is very sad to know that organization(s) owned by members are SO SO hesistant for positive changes. Instead of making changes we need, the organization(s) puts us back in medieval times.

Deaf Communites should continue contacting FCC to file complaint and boycotting such services. They have no business of throwing labels to a population they services while receiving federal funds. Also, censoring freedom of speech and social media while implementing their own agendas for NAD Presidential selection. Neutral and non-discriminatory must! Consequences. CSD has been harboring NAD and weakening its system for over a decade! About National Association of the Deaf and Dennis Daugaard.

The purpose of this vlog is to explain everything regarding Deaf people's response on National Association of the Deaf (NAD) for making a bad pick by inviting the Governor of South Dakota.

This blog also will include the transcript so that hearing people & Deaf people who does not know ASL will be able to understand why many Deaf people are protesting about the bad pick which NAD, so far, hadn't addressed this issue.

Here is the transcript of the 25-minute long vlog: The National Association of the Deaf was founded in 1880 in response to the Milan Conference of 1880.

Why? The International Congress on Education of the Deaf was held in Italy. All delegates except for one at ICED were hearing. They voted to support the oral education and banned the use of sign language for Deaf children at any Deaf schools. The result is that many Deaf teachers lost their jobs at many Deaf schools across this country as it also messed up Deaf education. This was the Dark Ages for Deaf people. NAD was established to protect the Deaf people's voice, civil rights & American Sign Language. Wonder why the NAD is not strong like the National Association for Advancement of Colored People (NAACP)? NAACP was able to have the access to media and make a difference in many people's lives, why can't the NAD have that as well? That part is a long story that will explain why NAD is like that but first, I want to focus on history of NAD.

16 years after NAD was established (1896), there was first woman to serve on NAD Board. Is it awesome? Does it means that NAD is progressive than the rest of the United States since women were allowed to vote in 1920? No, it is not true. That position has no-voting power. Their duties are focused only on social issues, events, morals, childbearing, child care - these are women's duties. They cannot get involved on Education, Civli Rights & Law with the rest of male-dominated NAD Board. When the 19th Amendment was ratified into the United States Constitution in 1920 to grant all women the right to vote, NAD still did not permit its Deaf women to vote until 1964!

The NAD responds to the outpouring of concern, opposition and support surrounding the community discussion on Governor Daugaard:

44 YEARS!! Why? Maybe the NAD resisted this change because they were wary of hearing people due to the devastating effects of Milan Conference. Then a year later in 1965, African-Americans (both men & women) were allowed to join the membership of NAD. As for GLBT individuals, NAD finally included them not a long time ago roughly about 10-15 years ago. Really, NAD was aware that there were many Deaf GLBT individuals but they chose not to recognize the GLBT individuals for decades. Now the GLBT people will have its first-ever Luncheon at 2012 NAD Conference in Louisville, Kentucky. NAD hosts biennial national conferences held in different cities across the country. For many years, the NAD Board as well as its Region I, II, III, IV Board tend to be populated by Deaf people with college degrees. For many years, NAD's growth was hindered due to low contributions, most likely because many Deaf people lost their jobs after the infamous Milan Conference of 1880. They slowly raised the funds for decades and finally has a permanent home in Silver Spring, Maryland. They also established the Youth Leadership Camp as well. They added little by little to strengthen the organization. As of now, NAD will have its conference in Louisville. This conference's theme is.

Every two years, NAD tends to select a theme that will reflect on its conference. This year, in Louisville has this theme, "Nothing About Us, Without Us". This conference is expected to be the largest one in history because NAD is partnering with Kentucky Commission for the Deaf and Hard of Hearing (KCDHH)'s famous & popular event called DeaFestival. That DeaFestival is extremely popular with Deaf people who does not have college background, averaging several thousands of spectators from many states. This is an opportunity for everyone to capitalize on touching important issues at the conference.
