Deaf Man Sues Pornhub For Lack Of Captions

Pornhub is being sued by a Deaf man because only a small percentage of the videos uploaded onto the website are captioned.

PHOENIX -- A man is reportedly suing an adult video website for alleged rights violations because there is a lack of closed captioning on at least some videos.

According to TMZ, Yaroslav Suris' lawsuit against Pornhub claims the lack of closed captioning violates the rights of Deaf and Hearing-Impaired under the Americans with Disabilities Act (ADA) of the United States Code.

To activate this feature, press the "CC" button.

In court documents cited by TMZ, Suris claims the Deaf and Hearing Impaired can't understand the audio portion of videos on the websites, and listed a number of videos that the man watched, but couldn't understand the dialogue.

In the documents, Suris reportedly claims he and those in similar situations would pay money for a premium subscription, but calls it pointless without the subtitles.

Suris, according to the TMZ report, is suing for Pornhub to add closed captioning, in addition to damages. Pornhub officials told TMZ the website does have a closed captions category, and says the company generally does not comment on active lawsuits. This is not the first time the issue of closed captioning for online videos has been in the spotlight.

According to a 2015 report by the BBC, a YouTuber named Rikki Poynter raised awareness for closed captioning on YouTube. A video made by Poynter on the issue was cited by popular YouTuber Tyler Oakley as an inspiration for him to add closed captioning to all his videos on YouTube.

Rikki Poynter is a Deaf vlogger on YouTube. She makes content about Deaf awareness, accessibility/closed captioning awareness, mental health, feminism, and more, subscribe to Rikki Poynter Channel on YouTube.

Deaf Woman Suing Jack in the Box

Deaf California woman suing Jack in the Box fast food restaurant for refusing service at drive-thru.

SAN JOSE, California -- ReVae Arnaud-Jensen is not a confrontational woman. She describes herself as a hardworking, responsible, single mother of three.

But, when she tried to order at a Jack in the Box in Campbell on Aug. 31 and the man behind the counter refused her service, as captured on video, she knew she had to stand her ground.

Arnaud-Jensen is profoundly Deaf, no hearing at all. She was born that way. While she can read lips, she could not hear the voice over the speaker.

To activate this feature, press the "CC" button.

When she proceeded to the next window to explain, the employee was angry that she was not responding. She stayed for two hours and never got her order.

"I was just fed up, the constant, you know, telling us to go, to go, when it should be equal access," she said.

There are approximately 40 million people who are Deaf or Hard of Hearing in the United States. Arnaud-Jensen says she is fighting for the entire community. It's one of the reasons why she posted the video on Facebook.

"I don't like confrontation, but I fight for equal access," she said.

Arnaud-Jensen says she spoke to the manager of the store and was told the employee was fired. But, she is standing her ground and even pursuing legal action for this reason.

"Things done to us, not okay, I will stand and fight for that, for everyone in the community, it's for you guys, the community, not me but for them, so there will be no more suffering for the Deaf community."

She says this kind of discrimination happens to her almost every day and it needs to stop. Arnaud-Jensen says she is demanding, at the very least, that Jack In The Box train their employees, including the CEO to understand Deaf culture.

ABC7 News reached out to Jack in the Box. In a statement, they sent ABC7 this response:

"We have been informed of the incident that took place between an employee and hearing-impaired guest, in the drive-thru at a Campbell, California restaurant on August 31st. We do not tolerate the mistreatment of any customers and expect employees to follow all training procedures, be respectful, courteous and accommodating to all guests. After a thorough investigation of the incident and direct contact with the local franchise owner, we understand the employee in the video has been terminated."

Deaf Woman Suing Burger King

Deaf Oklahoma woman suing Burger King fast food restaurant after she was refused service because she's Deaf.

OKLAHOMA CITY -- An Oklahoma woman says she was refused service at a metro Burger King because she’s Deaf. Rachel Hollis says she was stopping to get food after taking her two sons to hockey practice.

“I had my order ready, I had it typed on my phone. I do that often when I go through drive-thrus, it hasn’t ever been an issue," Hollis told News 4 through an interpreter. "I show him my order, and he gives me this face of frustration.”

Hollis says she started taking a video of the incident because she was feeling uneasy, then in the video you can see the employee hand her a note that says, “Can’t do a full order at the window. Too busy.”

Eventually, the employee comes back to the window and starts arguing with Hollis.

“You have to come inside. It’s too busy. Too busy ma’am, I can’t do a full order at the window I’m sorry," the employee says to Hollis. "It has nothing to do with your disability, I have a disability too."

After that, he slams the window shut. Hollis says one of the worst parts about the whole experience was that it happened with her kids in the car.

"I could tell they knew something was going on, I was just trying to keep them calm," Hollis said. "I said I’ll explain it to you when we get home. But they knew something was going on.”

Hollis says she tries to stay calm in that moment, but she’s tired of people being treated that way.

“When I got home, that was when I really broke down. I was very upset, I was crying, I was very tired. I’m tired of discrimination,” Hollis told News 4 through an interpreter. “I’ve never experienced anything like that, for someone to call the police. That’s crazy, it just doesn’t seem right.”

There`s a big update in the case of a Deaf woman who says she was denied service at a metro Burger King: Rachel Hollis has hired a legal team to represent her, claiming the restaurant is violating the Americans with Disabilities Act.

News 4 reached out to the Burger King corporate office about the situation, in a statement Burger King said:

All guests should be treated with respect and provided with a high level of service at our restaurants. The restaurant owner has reached out to the guest and her family to apologize, the employee was terminated and all employees at the location will undergo additional sensitivity training to ensure our customers always feel welcomed.

Philly Police Discriminates Against The Deaf

Deaf News: U.S. Justice Department concludes Philadelphia police discriminate against the Deaf or Hard of Hearing.

PHILADELPHIA, PA -- A U.S. Department of Justice review has found the Philadelphia Police Department discriminated against people who were Deaf or Hearing-Impaired.

Philadelphia police handcuffed Deaf people behind their back, thus making them unable to communicate with sign language, DOJ wrote in a Dec. 7 letter to the department.

Police did not inform courts that defendants appearing for a video arraignment were Deaf, so the individuals did not understand what was happening, according to the review.

And police failed to provide qualified sign-language translators or other services to defendants, victims, and witnesses, according to the review.

DOJ said it was seeking to remedy the problems cooperatively through a consent decree with the department.

"In the event that we are unable to reach such a resolution, the Attorney General may initiate a lawsuit pursuant to the [Americans with Disabilities Act]," the letter states.

The Police Department issued a statement Friday evening saying it would work with DOJ to fix any problems.

"While the finding and conclusion regarding the complaint are sobering, we appreciate the DOJ's work and their input regarding the matter," the Police Department said.

"We are using this as an opportunity to address a legitimate concern and make necessary improvements. The department's goal is to move beyond remedial measures with a commitment to making this department a model for others in adhering to the provisions of the Americans with Disabilities Act."

The Police Department said it would collaborate with the city's Office of the Chief Diversity and Inclusion Officer and with the Mayor's Commission on People with Disabilities.

The Justice Department review was prompted by a complaint from a man who had been arrested, and that led to four other people who alleged discrimination by police.

According to the original complaint:

In 2013, a 23-year-old man who was Deaf was arrested in court after he threw a bracelet hitting two people during a sentencing hearing for his brother.

He was handcuffed behind his back, making him unable to use sign language. While in police custody, a radio room staffer was identified as having some sign language ability, but the man could not understand what was being communicated.

The man asked for a qualified interpreter, but police ended their attempt to communicate and placed him in detention for 16 hours.

During his video arraignment the next morning, the judge was not told he was Deaf and the video was not captioned.

Two months later, police arrested him mistakenly for failing to appear in court. His hearing had actually been scheduled for a later date.

He was again handcuffed behind his back, but after his mother intervened, the officers cuffed him in the front. When he explained the hearing had been rescheduled, the officers asked for documentation but would not allow him to search for it.

After he was detained and released, he asked for a telecommunication system for the deaf, but the one police provided him did not work.

Deaf Immigrant Awarded $250K Settlement

Deaf Man receives $250K settlement after being jailed with no access to interpreter in Virginia.

ARLINGTON, Virginia -- NBC4 Washington: A Deaf man will receive a $250,000 settlement from the Arlington County Sheriff's Office after it failed to provide a sign language interpreter for him while he was jailed, the U.S. Attorney's Office announced Friday.

The man, Abreham Zemedagegehu, has said he spent part of his six-week stay at the Arlington County Detention Facility in 2014 unaware of the charges against him. The Justice Department launched an investigation into Zemedagegehu's claim last year.

NBC News covered a story about Abreham Zemedagegehu and his experience in jail without an interpreter.

"I felt like I was losing my mind," Zemedagegehu said through an interpreter in an interview at his lawyer's office. "I thought Virginia would give me an interpreter and they said no. That's why I felt lost."

Zemedagegehu also said the jail failed provide a communications device to help him communicate with his lawyer and performed medical procedures on him without explaining them or getting his consent.

A native of Ethiopia, he can communicate in American Sign Language but is largely unable to communicate in written English.

Zemedagegehu sued the sheriff's office in federal court, saying his treatment failed to meet the standards of the Americans with Disabilities Act (ADA).

Among the concerns raised in his lawsuit was the jail's reliance on teletypewriter devices to allow Deaf inmates to communicate with people outside the jail. The sheriff's office has defended its use of the TTY machine, but Zemedagegehu's lawsuit said the device is useless for someone who can't read English and obsolete because videophones are now used predominantly in the Deaf community.

Zemedagegehu's ordeal began Feb. 2, 2014, when he was arrested after being accused of stealing another man's iPad. He said he pleaded guilty to the charge because a plea bargain offered him a sentence of time served. Later, though, the man who accused him of the theft said he'd found the device and rescinded his accusation.

Under the settlement, the sheriff's office will pay $250,000 to Zemedagegehu, and must take steps to comply with the ADA. This includes appointing an ADA coordinator, providing ADA training to its staff, and ensuring that auxiliary aids and services are provided. The Justice Department said the sheriff's office has taken several steps to improve its ADA compliance even before finalizing the settlement agreement.

"People who are Deaf or Hard of Hearing must be able to communicate clearly with law enforcement officials," said Tracy Doherty-McCormick, First Assistant U.S. Attorney for the Eastern District of Virginia, in a statement Friday. "Through this settlement agreement, the Arlington County Sheriff has taken important steps to ensure that the operations of the Arlington County Detention Facility are in compliance with the Americans with Disabilities Act."

McDonald's Refuses Interview Deaf Applicant

McDonald's pays up $56,000 to the EEOC after manager refuses to interview Deaf applicant in Missouri.

BELTON, MO -- (AP) McDonald's will pay a $56,500 settlement after a southeast Missouri restaurant manager refused to interview a Deaf job applicant.

The U.S. Equal Employment Opportunity Commission on Tuesday announced the settlement with McDonald's Corp. and McDonald's Restaurants. A message seeking comment from the Oak Brook, Illinois-based company was not immediately returned.

The EEOC says a young man who can't hear or speak applied online in 2012 to work at the McDonald's in Belton, Mo. He had previous experience as a cook and cleanup team member at a McDonald's restaurant in another state.

A lawsuit filed by the EEOC says that when the restaurant manager learned the applicant needed a sign language interpreter for his interview, she canceled the interview, even though the applicant's sister volunteered to interpret.

Deaf White House Receptionist Gives Tour

WATCH [CC] - The White House released video of first Deaf White House receptionist giving a tour of the residence.

WASHINGTON -- In celebration of the 26th anniversary of the Americans with Disabilities Act (ADA), the White House released a video of the first Deaf White House receptionist giving a tour of the residence.

Leah Katz-Hernandez first interned at the White House in 2010 and President Obama talked about her at the 25th anniversary last year of the ADA, a civil rights law that prohibits discrimination in employment, housing, service, transportation and more against people who have disabilities.

“We call her ROTUS,” the president explained. “I’m POTUS, this is VPOTUS and that’s ROTUS. And ROTUS is the first Deaf American to hold that job. She is poised, she is talented -- and, as she puts it, a lot of her accomplishments may not have been possible without the ADA."

Deaf Woman Sues Taco Bell Over Drive-Thru

Deaf New Jersey woman sues Taco Bell over drive-thru orders.

TRENTON, NJ -- A Deaf Atlantic City woman who primarily communicates in sign language is suing Taco Bell, saying she found it difficult, if not impossible, to order two tacos at the fast-food chain's drive-thru window.

To activate this feature, press the "CC" button.

Gina Cirrincione said in her federal lawsuit that on Jan. 11, she wrote her order on a slip of paper and handed it to an employee at the drive-thru pickup window at a Taco Bell in Pleasantville, New Jersey.

Her video of the exchange, provided to The Associated Press by her lawyer, showed an employee trying to explain that orders are placed at the start of the drive-thru.

"I will do it this one time," he then said. "I want you to understand me, one time. After that, no more. After that, no more. Come inside. OK, is that fair?"

On March 15, Cirrincione said, she wrote her order on a slip of paper and handed it to a drive-thru employee at a Taco Bell in Atlantic City. The note was returned and the window was shut without the order or an explanation, she said. She said she entered the store and was ignored.

Taco Bell's drive-thru system requires a customer to hear and speak, making it inaccessible to the Deaf in violation of the Americans With Disabilities Act, the lawsuit claims.

Taco Bell spokeswoman Laura Nedbal said in a statement Friday to the AP that the California-based company had not yet received the lawsuit so could not comment on it. However, she added, "Taco Bell has a fundamental policy to respect all of our customers and employees, and we are committed to maintaining an environment free of discrimination or harassment."

Cirrincione wants Taco Bell to develop a policy to consider the needs of Deaf customers and to train employees about their rights. She also is seeking punitive and compensatory damages.

"With today's technology and the sophistication of Taco Bell, there is no excuse that their drive-thrus cannot be accessible," said attorney Eric Baum of The Eisenberg & Baum Law Center For The Deaf and Hard of Hearing, who is representing Cirrincione.

Deaf Grassroots Movement at Florida State Capitol

Deaf News: Deaf protestors say its time to fight inequality, discrimination and oppression by the hearing in the state of Florida.

TALLAHASSEE, FL -- Tallahassee Democrat: Nearly 30 members of the Deaf Grassroots Movement rallied Wednesday at the Old Capitol. It was part of a nationwide demonstration at all 50 state capitals to call for better education, more job opportunities and acceptance by society in the Untied States.

The DGM aims to fight for the rights of the Deaf and future generations in the Deaf community in all 50 states. On Wednesday all 50 state capitols will have a rally for Deaf Rights, including Tallahassee, Florida.

Occasionally cars passing by on Monroe Street would honk their horns in support, but there was no reaction from the protestors. They were a quiet bunch but fingers started flying, eyes grew wide and faces filled with expressions when word spread a reporter was in their midst.

“So I can’t hear,” Bob Webb of Tallahassee signaled to a man carrying a notebook. “I have a brain. I have a heart.”

The Deaf Grassroots Movement formed in September after a protest at the White House in Washington, D.C. The group says education opportunities for Deaf children are abysmal when compared to those of children who can hear.

The activists planned the 50-state rally to raise awareness of their plight and to issue a call to action to the Deaf community and its allies to fight inequality, discrimination and the oppression Deaf people face.

Webb indicated that the Americans with Disabilities Act was a good thing but needed to be amended to include services geared toward the Deaf.

The group protesting in Tallahassee ranged in age from a middle-school student, who carried a sign saying “Please Invest in My Education,” to an elderly man with a long gray ponytail and ZZ Top-like beard.

Other signs proclaimed sign language as a birthright language, explained that hearing doesn’t make you a better person and listed how the hearing discriminate against the Deaf.

Webb explained the Deaf community feels the state is failing to provide them an equal opportunity in education, employment and in pursuing the American dream.

When asked what he wanted, Webb took to pen and paper from and wrote,

Stop discriminating against us in employment.
Audioism hurts us because they want us to be like hearing people.
Give us fair access, like all other communities.

“Don’t limit me,” Webb signaled. “So I can’t hear. So what?”

Deaf Grassroots Movement at Idaho State House

Deaf News - Deaf community holds rally at the Idaho State House.

BOISE, ID -- Several members of the Deaf community gathered Wednesday afternoon in front of the Statehouse to raise awareness of the issues they say they're facing here in Idaho. It was one of 50 rallies hosted by the Deaf Grassroots Movement, taking place simultaneously in all 50 states.

The DGM aims to fight for the rights of the Deaf and future generations in the Deaf community in all 50 states. On Wednesday all 50 state capitols will have a rally for Deaf Rights, including Boise, Idaho.

"One of the biggest problems is their limiting or ability to communicate," said presenter David G. Wilder.

They want to educate others on what can be done to make their lives better.

"We got a lot of issues that we are faced with," said Alan Wilder of the Idaho Association of the Deaf. "The American with Disabilities Act that was set up a long time ago, but it's not quite sufficient enough, enough where as Deaf people are still fighting everyday to receive interpreters or get equal access to information."

Organizers say that quality education, jobs and healthcare just aren't available to many Deaf people in the state. Because, they say, they don't have access to qualified sign language interpreters.

"In smaller communities it's not very well set up, but you know in hospitals they usually have that, but if you go to doctor's office or counseling services, they don't have those services," said Alan Wilder.

And while these people are all too familiar with the challenges they face every day. They say no one else will talk about them without them.

Alan Wilder said the Idaho Association of the Deaf plans to push for stronger and clearer laws surrounding Deaf interpreters in Idaho in 2017. Copyright 2016 KTVB.

Deaf Grassroots Movement Rally at RI State House

Deaf News: Deaf Grassroots Movement supporters rally at the Rhode Island State House.

PROVIDENCE, R.I. -- The Providence Journal: About 80 people, most of them Deaf and wearing bright green T-shirts that illustrated the sign language for "equality," followed by the word "now!" rallied at the State House on Wednesday.

The rally was one of 50 all-day rallies taking place around the country in the Deaf Grassroots Movement.

The DGM aims to fight for the rights of the Deaf and future generations in the Deaf community in all 50 states. On Wednesday all 50 state capitols will have a rally for Deaf Rights, including Providence, Rhode Island.

Some of those wearing the green shirts, which listed the movement's five goals on the back - education, jobs, language rights, equal accessibility and communication access were supporters of a Deaf person, and some in their own matching black T-shirts were members of an interpreters group.

Governor Raimondo's outreach manager, David Allard, listened to the spoken interpretation as each speaker signed to the group. When Allard spoke, a sign-language interpreter stood beside him to sign his statement that the governor is committed to creating opportunities for all Rhode Islanders.

Jill DeCosta, 53, of Smithfield, was one of the organizers and spoke of feeling invisible at her job in the Rhode Island Family Court because she is excluded from meetings and conferences for lack of an interpreter.

She said that nationwide, 72 percent of Deaf people are unemployed, and that in Rhode Island, the Office of Rehabilitation Services has had a Deaf services position go unfilled for months.

Instead of clapping, the Deaf-Friendly crowd applauded each speaker by fluttering their hands in the air.

A class from the Rhode Island School for the Deaf attended.

Charley Thorn, 32, of Chepachet, who is Deaf and who works as an interpreter for the Deaf, repeated each speaker's sign language directly to a woman who who is Deaf as well as legally blind.

He said later, through an interpreter, that he appreciated the chance to let "our voice be heard."

"All we want to do is have equality with communication," he said.

Doctor's offices and hospitals often do not provide an interpreter for a Deaf person, attendees said, nor are interpreters provided for a Deaf applicant at a job interview. In both cases, the Americans with Disabilities Act requires that an interpreter be provided.

Rhode Island doesn't have enough interpreters and lacks an interpreter training program, said Steven Florio, executive director of the R.I. Commission on the Deaf and Hard of Hearing.

Deaf Grassroots Movement at Oklahoma Capitol

Deaf News: Deaf Grassroots Movement rallies at the Oklahoma Capitol.

OKLAHOMA CITY -- Nearly 200 people marched at the Oklahoma State Capitol in support of expanded services for the Deaf community.

Participants from Oklahoma's Deaf Grassroots Movement joined a national effort on Wednesday to demonstrate the needs of the Deaf in education, employment and access to communication.

The DGM aims to fight for the rights of the Deaf and future generations in the Deaf community in all 50 states. On Wednesday all 50 state capitols will have a rally for Deaf Rights, including Oklahoma City, Oklahoma.

Deaf Grassroots Movement spokesman Chris Reagle says unemployment rates are particularly high for the Deaf and that they often face discrimination in the workplace and barriers in education. Reagle says one of the goals nationally is to amend the Americans with Disabilities Act to include services geared toward the Deaf.

In Oklahoma, Reagle says the group is pushing specifically for more Deaf interpreters to help children in public schools.

Deaf Grassroots Movement at Alabama Capitol

Deaf News: Deaf Grassroots Movement at the Alabama State Capitol.

MONTGOMERY, AL -- WVTM13‎: In a day and age when communication seems to be getting easier with the increase in modern technology, there are still communication barriers for some citizens. The Deaf Grassroots Movement or DGM wants to break down those communication barriers.

The rally has been full swing since 9 a.m. today in Montgomery to bring awareness to issues like communication, education, jobs and equal access in the Deaf community.

“The Deaf community has been 'asleep' and has accepted the status quo," representatives from the DGM said.

The DGM aims to fight for the rights of the Deaf and future generations in the Deaf community in all 50 states. On Wednesday all 50 state capitols will have a rally for Deaf Rights, including Montgomery, Alabama.

"We've not been sleeping and accepting this, we've been oppressed. Hearing people have enormous control over the lives of Deaf people," said Susan Motylinski Lambert, one of the activists representing central Alabama at the rally in Montgomery.

They hope to serve as the new watchdog and backbone for the Deaf community. They want to provide state support to a diverse number of people within the Deaf community: From the educated to those who are stricken into poverty status due to the issues the DGM is fighting to address.

McDonald's Charged In Discrimination Deaf Job

Deaf News: McDonald's charged by EEOC after canceling interview for Deaf job-seeker in the state of Missouri.

KANSAS CITY -- McDonald’s Corporation has been charged with disability discrimination by the U.S. Equal Employment Opportunity Commission for refusing to provide a sign language interpreter for a Deaf employee candidate.

Ricky Washington, who is Deaf, applied online for a job at a McDonald’s restaurant in Belton, Missouri, in June 2012. When the Belton restaurant manager learned Mr. Washington needed a sign language interpreter for his job interview, she canceled the interview and never rescheduled it, despite Mr. Washington’s sister volunteering to act as the interpreter, the Equal Employment Opportunity Commission said in a statement issued Monday.

Mr. Washington indicated on his application that he attended Kansas School for the Deaf and that he also had previous job experience working as a cook and clean-up team member at a McDonald's restaurant in Louisiana in 2009.

Restaurant management continued to interview and hire new workers after Mr. Washington made several attempts to schedule an interview, according to the agency.

After first attempting to reach a prelitigation settlement through its conciliation process, the EEOC charged Oak Brook, Illinois-based McDonald’s Corporation. and McDonald’s Restaurants of Missouri Inc. in U.S. District Court in Kansas City, Missouri, with violating the Americans with Disabilities Act by refusing to accommodate and hire a Deaf applicant.

“Removing obstacles in the hiring process for people with disabilities is a national priority for EEOC,” said James R. Neely Jr., EEOC’s St. Louis district director. “All employers, but especially large ones, should join with the agency to make sure everyone has equal access to the employment process.”

The Belton restaurant where Mr. Washington applied for work is owned and operated by McDonald’s Corp., the statement said.

Deaf Woman Sues NYPD For Denying Interpreter

WATCH [CC] - Deaf woman sues NYPD for denying sign language interpreter for nearly 24 hours after she was arrested, locked up.

NEW YORK CITY -- A Deaf woman who is also speech-impaired has sued the New York City Police Department for denying her a sign language interpreter for nearly 24 hours after she was arrested and locked up overnight, according to papers filed in Manhattan Federal Court.

Opal Gordon was arrested Sept. 21 as she left Manhattan Family Court for allegedly violating an order of protection. She was at court for a custody case about her daughter.

To activate this feature, press the "CC" button.

Gordon, of Manhattan, who is “profoundly Deaf and speech-impaired,” said cops didn’t tell her why she had been arrested nor did they provide her with an interpreter. They also didn’t read her Miranda rights, she said.

Police brought Gordon, 53, to the 45th Precinct stationhouse in the Bronx and held her there for two hours, she said. “The boss who runs the precinct signed to me and asked if I am Deaf. I said ‘Yes,’” she told the Daily News. But none of the officers called for a sign language interpreter or gave her anything that would help her communicate with them, she said.

“Not even a piece of paper,” Gordon added.

The officers brought her to a holding cell in Bronx Central Booking and she was held overnight, according to her lawsuit. Gordon claims she repeatedly tried to communicate her need for a sign language interpreter but was ignored.

“No one would listen to me,” she said.

It took the NYPD 21 hours to get a sign language interpreter to help Gordon, her lawsuit said.

The city’s Administration for Children’s Services visited Gordon’s home in October as part of its Manhattan Family Court case. Even though ACS knew Gordon was Deaf, the agency didn’t bring an interpreter upsetting Gordon because the visit, part of a court-ordered investigation, could affect her custody case.

“This is nothing new for the city,” said Gordon’s lawyers Eric Baum and Andrew Rozynski, who represent many Deaf clients.

Deaf Woman Sues NYPD For Wrongly Arrested

Their law firm said the NYPD has a 2009 consent decree with the Justice Department to improve its treatment of the Deaf community. But the city and the NYPD continue to violate the civil rights of Deaf people, according to the lawyers.

The city Law Department didn’t comment on the pending litigation. “We will review the suit and respond accordingly once we are served,” a spokesman said. SOURCE - NEW YORK DAILY NEWS
