Deaf Man Sues Pornhub For Lack Of Captions

Pornhub is being sued by a Deaf man because only a small percentage of the videos uploaded onto the website are captioned.


PHOENIX -- A man is reportedly suing an adult video website for alleged rights violations because there is a lack of closed captioning on at least some videos.

According to TMZ, Yaroslav Suris' lawsuit against Pornhub claims the lack of closed captioning violates the rights of Deaf and Hearing-Impaired under the Americans with Disabilities Act (ADA) of the United States Code.

In court documents cited by TMZ, Suris claims the Deaf and Hearing Impaired can't understand the audio portion of videos on the websites, and listed a number of videos that the man watched, but couldn't understand the dialogue.

In the documents, Suris reportedly claims he and those in similar situations would pay money for a premium subscription, but calls it pointless without the subtitles.

Suris, according to the TMZ report, is suing for Pornhub to add closed captioning, in addition to damages. Pornhub officials told TMZ the website does have a closed captions category, and says the company generally does not comment on active lawsuits. This is not the first time the issue of closed captioning for online videos has been in the spotlight.

According to a 2015 report by the BBC, a YouTuber named Rikki Poynter raised awareness for closed captioning on YouTube. A video made by Poynter on the issue was cited by popular YouTuber Tyler Oakley as an inspiration for him to add closed captioning to all his videos on YouTube.

How Technology Can Enrich Deaf Lives

SAN FRANCISCO, California -- This is a historical event for Talks at Google, because it is completely conducted through American Sign Language (ASL).

Model, actor, and activist Nyle DiMarco sits down with Google during our annual Accessibility Week to talk about Deaf culture, the mission and vision behind his foundation, and ways to reduce language deprivation for Deaf and Hard of Hearing children through technological solutions. DiMarco discusses the need to include Deaf people in the process of new technological implementations and how important of an impact that will make on our world.

Nyle DiMarco has been breaking down barriers and winning over audiences since 2014. As a fan favorite on cycle 22 of America's Next Top Model, he became the second male winner and first Deaf contestant on the hit CW series.

The following year, partnered with Peta Murgatroyd, he took home the coveted mirror ball trophy on season 22 of ABC’s Dancing With the Stars.

DiMarco has quickly become the face of not only the Deaf community but disabled people worldwide (1.4 billion people with disabilities worldwide and 466 million people with hearing loss). He founded The Nyle DiMarco Foundation, which focuses on bilingual education and aims to improve access to accurate information about early language acquisition.

DiMarco is an inspiration to many and speaks all over the world, spreading the word of inclusion and acceptance. As a producer, Nyle is working on various scripted and non-scripted projects with the overall goal of telling new stories and empowering disabled people both in front and behind the camera.

Deaf Speaker Joanne Chester "Not Just Deaf"

Deaf Woman Refused Service at Tim Hortons

Deaf Ontario woman alleges mistreatment after Tim Hortons drive-thru employee refuses service.


HAMILTON, Ontario -- A Deaf Hamilton woman is hoping for change after she feels she was discriminated against while using a coffee shop drive-thru.

Danna Morales, 26, posted on Facebook says she has been using fast-food drive-thrus her whole life without issue, until she visited a Tim Hortons on Sunday.


Morales says she showed the drive-thru cashier her order typed out on her iPhone, and after some fuss the staff reluctantly processed it. But when they neglected to give her some of the items that she had already paid for, she tried to explain that to them by typing it out on her phone.

The incident was recorded on camera by Morales’ partner Francis Mena, who was in the passenger seat. Mena’s cellphone video shows the employee at the window refusing to look at the phone.

“I can’t, you have to come around!” says the employee. “Too bad,, no!”

When Morales tries to explain the situation, the employee appears increasingly agitated.

“You’re holding my line, go!” she orders Morales.

“She didn’t need to have such attitude with me,” Morales told CTV News Toronto through an interpreter Wednesday.

“I think because of the way she reacted, it was a little discriminatory.”

The video shows other employees coming to the window and trying to assist.

“Go inside, I’m going to serve you,” says another employee.

“She can’t talk, she has to come inside,” says the main clerk at the window.

“She could have just read the order off the phone, given us our order and we would have been out of there,” Mena told CTV News Toronto, also through an interpreter.

“But instead she dragged it out and it made me feel a little hurt, a little uncomfortable.”

As the exchange continues, other drivers begin honking and one approaches the drive-thru window.

“Look at the line up here, I have to go,” a customer is heard saying in the video. “What is this?”

The employees eventually give Morales the rest of her order.

Morales and Mena returned to the location later that day with an interpreter, and they say the manager apologized and called the situation unacceptable.

Tim Hortons told CTV News Toronto in a statement the experience was “truly unfortunate” and does not reflect the company’s inclusive values.

“We want all of our guests to have a positive and welcoming experience at our restaurants. The restaurant has been working to rectify this,” a spokesperson said.

Morales says she would like to see more education for employees. Tim Hortons tells CTV News Toronto that it will be updating its accessibility training in light of Morales’ experience.

Morales also believes more should be done to improve drive-thru accessibility for Deaf people.

“How are we supposed to even order though a drive-thru when it’s a speaker system that’s inaccessible to us?” she said.

The City of Fredericton recently made plans to combat their own Tim Hortons drive-thru chaos by spending $40,000 to build a "traffic circle”. The move is an attempt to limit the amount of traffic that is clogging up the roads near one of the coffee shop's drive-thru locations.

A Deaf activist explains the importance of interpreters at live concerts on The Kelly Clarkson Show.


BURBANK, California -- A Deaf activist and founder of advocacy group DEAFinitely Dope, Matt Maxey, explains how sign language interpreters are necessary for live music events and what it's like experiencing music as a Deaf person.

Matthew Maxey hails from Decatur, Georgia and currently resides in Atlanta, Georgia. Born with a severely profound hearing loss, and outfitted with hearing aids at 2 years old, it became apparent at an early age that life would be anything but ordinary.

Fast forward and Matthew attended the prestigious Gallaudet University in Washington, DC where he began to learn American Sign Language in an attempt to balance the struggle of developing his identity as a double minority in terms of ability and race.

In 2014, DEAFinitely Dope was founded as an idea based on providing support to those that felt marginalized and ignored by mainstream America.

DEAFinitely Dope started as a brand, and slowly blossomed into a movement, attracting the likes of educational institutions nationwide, CNN, ESPN The Undefeated, GQ, Cole Haan, ABC news, Chance The Rapper, MTV Video Music Awards, and countless more.

Jack in the Box Worker Mocks Deaf Customer

Viral video shows Deaf California woman berated at Jack in the Box drive-thru for not using speaker to order, employee fired for refusing service.


CAMPBELL, California -- ReVae Arnaud-Jensen is not a confrontational woman. She describes herself as a hardworking, responsible, single mother of three.

But, when she tried to order at a Jack in the Box in Campbell on Aug. 31 and the man behind the counter refused her service, as captured on video, she knew she had to stand her ground.

Arnaud-Jensen is profoundly Deaf, no hearing at all. She was born that way. While she can read lips, she could not hear the voice over the speaker.

When she proceeded to the next window to explain, the employee was angry that she was not responding. She stayed for two hours and never got her order.

"I was just fed up, the constant, you know, telling us to go, to go, when it should be equal access," she said.

There are approximately 40 million people who are Deaf or Hard of Hearing in the United States. Arnaud-Jensen says she is fighting for the entire community. It's one of the reasons why she posted the video on Facebook.

"I don't like confrontation, but I fight for equal access," she said.

Arnaud-Jensen says she spoke to the manager of the store and was told the employee was fired. But, she is standing her ground and even pursuing legal action for this reason.

"Things done to us, not okay, I will stand and fight for that, for everyone in the community, it's for you guys, the community, not me but for them, so there will be no more suffering for the Deaf community."

She says this kind of discrimination happens to her almost every day and it needs to stop. Arnaud-Jensen says she is demanding, at the very least, that Jack In The Box train their employees, including the CEO to understand Deaf culture.

ABC7 News reached out to Jack in the Box. In a statement, they sent ABC7 this response:

"We have been informed of the incident that took place between an employee and hearing-impaired guest, in the drive-thru at a Campbell, California restaurant on August 31st. We do not tolerate the mistreatment of any customers and expect employees to follow all training procedures, be respectful, courteous and accommodating to all guests. After a thorough investigation of the incident and direct contact with the local franchise owner, we understand the employee in the video has been terminated."

Deaf Woman Suing Burger King

Deaf Oklahoma woman suing Burger King fast food restaurant after she was refused service because she's Deaf.


OKLAHOMA CITY -- An Oklahoma woman says she was refused service at a metro Burger King because she’s Deaf. Rachel Hollis says she was stopping to get food after taking her two sons to hockey practice.

“I had my order ready, I had it typed on my phone. I do that often when I go through drive-thrus, it hasn’t ever been an issue," Hollis told News 4 through an interpreter. "I show him my order, and he gives me this face of frustration.”

Hollis says she started taking a video of the incident because she was feeling uneasy, then in the video you can see the employee hand her a note that says, “Can’t do a full order at the window. Too busy.”


Eventually, the employee comes back to the window and starts arguing with Hollis.

“You have to come inside. It’s too busy. Too busy ma’am, I can’t do a full order at the window I’m sorry," the employee says to Hollis. "It has nothing to do with your disability, I have a disability too."

After that, he slams the window shut. Hollis says one of the worst parts about the whole experience was that it happened with her kids in the car.

"I could tell they knew something was going on, I was just trying to keep them calm," Hollis said. "I said I’ll explain it to you when we get home. But they knew something was going on.”

Hollis says she tries to stay calm in that moment, but she’s tired of people being treated that way.

“When I got home, that was when I really broke down. I was very upset, I was crying, I was very tired. I’m tired of discrimination,” Hollis told News 4 through an interpreter. “I’ve never experienced anything like that, for someone to call the police. That’s crazy, it just doesn’t seem right.”

There`s a big update in the case of a Deaf woman who says she was denied service at a metro Burger King: Rachel Hollis has hired a legal team to represent her, claiming the restaurant is violating the Americans with Disabilities Act.


News 4 reached out to the Burger King corporate office about the situation, in a statement Burger King said:

All guests should be treated with respect and provided with a high level of service at our restaurants. The restaurant owner has reached out to the guest and her family to apologize, the employee was terminated and all employees at the location will undergo additional sensitivity training to ensure our customers always feel welcomed.

Deaf Protesters Complains of Police Brutality

The police took Deaf protesters to the streets of India.


PUNE, India -- Deaf community in Maharashtra has had enough. Pradeep More General Secretary of State Level Association of the Deaf passionately voices the demands of the community.

Deaf individuals gathered outside the Disability Commissioner's office in Pune have decided they will not take no for an answer. It is high time, the government provides accessibilty and quality education to Deaf people.

The group has decided to march to the Mantralaya to meet the Chief Minister Devendra Fadnavis in Mumbai, if their demands are not met.

The Pune Police on Monday resorted to lathi-charge to disperse a crowd of Deaf students who were staging a demonstration in Pune, resulting in 35 of the students getting injured in the incident. The cops also detained around 170 activists working for the Maharashtra Deaf Association but later released them.


Nearly 11,000 hearing-impaired youths from across Maharashtra had gathered outside the Social Welfare Commissionerate in Pune near the police commissioner’s office, pressing for their long-standing demands. Among other things, the students were demanding the right to quality education, prevention of fraudulent distribution of disability certificates to able-bodied individuals and provision of trained interpreters for deaf students, reports said.


The police action against the protesters, most of whom were students, was widely criticised by opposition political parties, with many slamming the BJP government for the state of affairs. Meanwhile, chief minister Devendra Fadnavis has ordered the Pune police commissioner to submit a detailed report on the matter by Tuesday morning, as per reports.

The Pune Police had said that it had decided not to proceed with the FIR process against the protesters and hence no FIR was filed. On the other hand, the cops have reportedly claimed that around 7 to 8 policemen had also suffered injuries during the protest... Read More: Times Now News.

Deaf, Black and a Victim of Police Brutality in America.


OKLAHOMA CITY -- AJ+ channel on YouTube share the video of Pearl Pearson, is a Deaf, Black man who survived a brutal beating by Oklahoma Highway Patrol in 2014. Not only were the troopers cleared of wrongdoing, but Pearl was also charged with resisting arrest. This is his story with english subtitles.


Three years later, Magdiel Sanchez was shot to death in his front yard in the same city. Though neighbors told officers that Magdiel was Deaf and couldn't hear their commands, they still shot him five times. The officers were cleared of wrongdoing, and the district attorney instead filed charges against the victim's family.

Note: When "deaf" is capitalized as "Deaf ," it's referencing the Deaf community, an important and empowering distinction to those in the community.

CBC's Kas Roussy looks at why signing during disasters can be so critical; to help tell the story she's joined by sign language interpreter Jennifer Hawkings.

Nyle DiMarco is a model, an actor and also an activist. In 2014 he became the second male winner and the first Deaf contestant to win American's Next Top Model. Only two years later he added the Mirror Ball Trophy to his collection after winning Dancing With the Stars,. As a model, he has walked the runway for Giorgio Armani at Milan Fashion Week. Yet, his greatest acchievement was to become the face of the Deaf community and disabled people worldwide.
