Deaf Man Parked Illegally, Slapped Officer

San Diego Police respond to use of force with mace and taser on Deaf man over a parking ticket.

SAN DIEGO, California -- San Diego Police are responding to allegations that they used excessive force on a Deaf man after he got upset over a traffic ticket.

It happened Monday afternoon on 5th Avenue in Hillcrest. The man, identified by SDPD as 48-year-old Jeffrey Robinson of Los Angeles, stopped in the resale shop, Flashbacks, to inquire about selling shoes.

His car was parked illegally in a 20-minute commercial loading zone on 5th Ave. near University Ave. The employees in the store say he was only parked there a few minutes when a parking enforcement officer showed up.

"He couldn't speak, so he was communicating via a legal pad we had, as he was writing something to ask us, he saw that he was going to get a ticket," said Tiara Arreloa.

Arreloa and a couple other witnesses say Robinson was using sign language to try to communicate with the parking officer when she pepper sprayed him.

"He wasn't touching her, his hands were just here. He was trying to talk to her," insisted Arreola.

SDPD Lt. Scott Wahl says the photos making the rounds on social media don't tell the whole story.

"There's a lot more going on then maybe the small angle that they see," said Wahl.

Wahl says according to the parking officer and three separate witnesses, Robinson ran towards the officer in an aggressive manner.

"He ended up slapping the parking enforcement officer's hand away as she put the ticket onto the windshield of his car. As she was backing away from him, he crumpled up the ticket and threw it at her, bounced it off of her chest," said Wahl.

He says Robinson pounded on the window of the officer's car and continued advancing toward her. He says she deployed pepper spray after he refused repeated orders to comply.

"Parking enforcement officers don't have to wait until they're punched in the face to protect themselves against somebody who is starting to demonstrate this type of behavior," said Wahl, who pointed out that parking attendants are not sworn officers.

"You gotta remember our parking enforcement officers are not police officers, they don't have bullet proof vests, they don't carry guns, they're not trained like a police officer is," said Wahl.

Deaf-Blind Woman Surfer Rides California Waves

The incredible moment a Deaf-Blind woman learns to surfing at the beach in California, 'I'm not afraid to get in the water, try something new'

SAN DIEGO, CA -- A 27-year-old Deaf-Blind woman decided to challenge herself this weekend when she learned to surf in San Diego, California.

Haben Girma, who was born Blind and Deaf and is now a disability rights attorney, took to the waves on Saturday at Swami's Beach with help from a surf instructor.

'One of the biggest barriers facing people with disabilities are negative attitudes, people assuming that someone who's blind can't do something, or assuming that someone that uses a wheelchair can't do something, but anything's possible,' Girma, from Berkeley, told CBS 8.

So Girma, the first Blind and Deaf Harvard Law School graduate, has decided to keep challenging herself.

'I've decided to explore the question, 'Can I learn to surf?',' Girma said.

Girma was named a White House Champion of Change and has given a TEDx talk on disability advocacy and public-service lawyers.

Her surf instructor, coach Matt Allen of the Maui Surf Academy, was worried about communication, but they persevered and used physical queues to get their timing in sync.

'It's obviously going to be tough to communicate as well as we normally can,' he told CBS 8. 'There's nothing i'd rather do than help someone's dreams come true.'

Deaf Driver Found Guilty In 'Zombie Walk' Crash

Deaf driver Matthew Pocci convicted of reckless driving 'Zombie Walk' crash in San Diego.

SAN DIEGO, California -- Deaf motorist who drove through a group of spectators watching the "Zombie Walk" parade in San Diego, seriously injuring one woman, was convicted Wednesday of felony reckless driving.

Matthew Pocci, 47, faces up to three years in prison when he is sentenced Dec. 11. Jurors deliberated a little more than a day before finding the defendant guilty.

"I'm disappointed. Matthew's extremely disappointed and hurt," defense attorney Ashby Sorensen said after the verdict. "He felt like he was a victim that day and he feels like he's a victim again for simply trying to protect his family."

Pocci testified that he was "very nervous" while waiting for pedestrians to move out of the way near Second and Island as he left the Comic-Con convention with his girlfriend and others on July 26, 2014. The defendant said he started to worry when a crowd surrounded his car and people sat on the hood.

"It's clear that they were very scared there at the end," Sorensen told reporters. The attorney said Pocci who has no prior criminal record could get probation at the time of sentencing.

Deputy District Attorney Anthony Campagna told jurors the defendant stopped for several minutes on Second Avenue, and even turned his engine off for a few moments, before honking his horn "loudly, aggressively" and driving into the group of onlookers.

Jurors saw video footage from three different angles.

Campagna said the fact that Pocci is Deaf didn't play much of a role in the crime...

Lifeguard Rescues Deaf Dog Got Stuck In Mud

Lifeguard rescues Deaf dog that got stuck in mud at San Diego beach.

SAN DIEGO, California -- A lifeguard rescued a service dog that became stuck in mud at Dog Beach in Ocean Beach Wednesday.

Just after 5 p.m., a woman told authorities that she was walking the dog which belonged to a quadriplegic veteran when the animal somehow broke free and ran away. The dog, a German wirehaired pointer named Rita, then became stuck in a muddy area of the beach.

"It was up to her neck and it was terrifying," said Joey Riley, the veteran's caregiver. She was signing to the 12-year-old dog, which is Deaf.

"As I stepped, my feet would sink down into the mud so I backed up so that I didn't get into the same situation as she did," said Riley.

It was a situation she was well aware had killed a man a year earlier, who became trapped when the tide washed in. Lucky for Rita, help arrived in the form of a lone rescuer, San Diego Lifeguard Chuck Davey.

"I was able to get the front paws onto the board and then I had to dig down into the organic matter and pull the dog up onto the board," he said. Using a surfboard, he was able to free the dog from the thick mud. Riley made her way to the animal and was able to call it over. No injuries were reported.

Deaf Driver Hit and Run Zombie Walk

Watch the raw footage of a Deaf man arrested after running over a woman at comic-con in San Diego.

SAN DIEGO, California -- A raw footage of the vehicle running over a 64-year woman has emerged, showing the extent of injuries, including exposed flesh, muscle tissue and bone. While there were initial claims that the motorist heard threats in other online footage, the driver of the vehicle is allegedly Deaf.

The man claims he waited for the mass of people to pass, but they attacked his car, breaking his windshield and frightening his young children, he claims.

The Deaf man put his foot down and drove off to escape, but hit a nearby woman who was not participating in the walk. While police were at the head of the parade, no other police were present at any intersections.

The San Diego Zombie Walk was a non-sanctioned event of Comic Con 2014. The organizers of the Zombie Walk required all participants to obey traffic laws, including obeying traffic signals and laws around blocking vehicles which may have right of way.

The woman was seriously injured, and taken to a local hospital. Police have subsequently reported that the Deaf driver is not likely to face any charges.
