Taco Bell employee fired after video shows him refusing to serve man who is Deaf.

KETTERING, OH -- NBC News: A Taco Bell employee in Ohio was fired after he was accused of refusing to serve a Deaf man who was trying to use his cellphone to place an order in the drive-thru.

In a video of the encounter at a Taco Bell in Kettering on New Year's Eve, 25-year-old Brandon Washburn is seen trying to get the workers' attention by holding his phone up to the closed window.

When one worker finally opened the window, he's heard in the video telling the man: “It’s against company policy. I can’t do it.”

Washburn's mother, Becky Rosemont Burch, who posted the video Wednesday on her Facebook page, told NBC News in a phone interview on Friday that her son always uses his phone to write his order when he's in the drive-thru.

“He has done this many times before at other restaurants, and has never had a problem,” she said.

Burch said the worker seen in the video was trying to tell Washburn that it was against company policy to take the order through the drive-thru and wanted her son to come inside.

“He didn’t understand what the problem was,” Burch said about her son, adding that he “knew he was being discriminated against.”

“There were several people you could see in the video, and no one tried to help,” she said.

At one point in the video, the Taco Bell worker is seen shaking his head at Washburn before closing the window and walking away. Washburn continued to try and get the workers' attention.

When the Taco Bell employee returned and saw Washburn still at the window, he is heard threatening to call 911.

"And you’re also not allowed to record me," the worker added, pointing to Washburn's girlfriend, who Burch said was filming the encounter.

Burch said in her Facebook post that the employee discriminated against her son because he is Deaf.

“I taught him to be independent,” she told NBC News. “It was just very hurtful. It’s not like deafness is anything new.”

The video has been shared on Facebook more than 12,000 times with many comments calling out the worker.

Taco Bell said in a statement to NBC News that the worker, who was not identified, “no longer works for their organization” and all other employees at the Kettering location would be “retrained” on their policies.

“Taco Bell has a fundamental policy to respect all of our customers and employees, and we are committed to maintaining an environment free of discrimination or harassment,” the company said.

The National Association of the Deaf said in a statement to NBC News that all national fast-food restaurants with a drive-thru should "work with our organization to develop and disseminate a systemic fix so that none of their franchises and facilities ever again deny service to Deaf and Hard of Hearing customers."

Deaf Woman Sues Taco Bell Over Drive-Thru

Deaf New Jersey woman sues Taco Bell over drive-thru orders.

TRENTON, NJ -- A Deaf Atlantic City woman who primarily communicates in sign language is suing Taco Bell, saying she found it difficult, if not impossible, to order two tacos at the fast-food chain's drive-thru window.

Gina Cirrincione said in her federal lawsuit that on Jan. 11, she wrote her order on a slip of paper and handed it to an employee at the drive-thru pickup window at a Taco Bell in Pleasantville, New Jersey.

Her video of the exchange, provided to The Associated Press by her lawyer, showed an employee trying to explain that orders are placed at the start of the drive-thru.

"I will do it this one time," he then said. "I want you to understand me, one time. After that, no more. After that, no more. Come inside. OK, is that fair?"

On March 15, Cirrincione said, she wrote her order on a slip of paper and handed it to a drive-thru employee at a Taco Bell in Atlantic City. The note was returned and the window was shut without the order or an explanation, she said. She said she entered the store and was ignored.

Taco Bell's drive-thru system requires a customer to hear and speak, making it inaccessible to the Deaf in violation of the Americans With Disabilities Act, the lawsuit claims.

Taco Bell spokeswoman Laura Nedbal said in a statement Friday to the AP that the California-based company had not yet received the lawsuit so could not comment on it. However, she added, "Taco Bell has a fundamental policy to respect all of our customers and employees, and we are committed to maintaining an environment free of discrimination or harassment."

Cirrincione wants Taco Bell to develop a policy to consider the needs of Deaf customers and to train employees about their rights. She also is seeking punitive and compensatory damages.

"With today's technology and the sophistication of Taco Bell, there is no excuse that their drive-thrus cannot be accessible," said attorney Eric Baum of The Eisenberg & Baum Law Center For The Deaf and Hard of Hearing, who is representing Cirrincione.

Taco Bell Complains About Deaf Customers

Taco Bell employee inadvertently leaves his drive thru microphone on and is captured complaining about Deaf customers.

According to the videographer from Springfield, Illinois - They left the microphone on and not only was he be (sic) insensitive to Deaf people he also was using foul language.

The Taco Bell staff did nothing when confronted and of coarse (sic) they screwed up our order. Taco Bell is obviously discriminating and failing to serve for Deaf customers as well. Note: no captioning, only audio.

Taco Bell is an American chain of fast-food restaurants, they serve a variety of Tex-Mex foods including tacos, burritos, quesadillas, nachos, other specialty items, and a variety of "value menu" items. However, Taco Bell is failing to serve for Deaf customers which cannot to communaute through the microphone by drive-thru.
